~,~~ CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-02 <br /> <br /> RESOLUTION RATIFYING THE ACTION OF THE CITY <br /> ATTORNEY CERTIFYING THAT CITY ASSESSMENTS <br /> COMPLY WITH PROPOSITION 218 <br /> <br />WHEREAS, every year cities (and some special districts) throughout Alameda County request <br /> the County to place on upcoming property tax bills taxes and assessments that the <br /> cities and the special districts have levied; and <br /> <br />WHEREAS, this year, because of Proposition 218 concerns, the County Auditor requested the <br /> requesting agencies (1) to certify that the taxes and assessments that were to be <br /> placed on the 1997/98 tax bill meet the requirements of Proposition 218, and (2) to <br /> indemnify the County should there be a challenge to the tax or assessment on <br /> grounds that it doesn't comply with the requirements of Proposition 218; and <br /> <br />WHEREAS, because City staff had discussed these various assessments at length with the City <br /> Council in context of Proposition 218 and because the Council had taken action to <br /> continue to levy these various assessments, the City Attorney felt he had the <br /> authority to sign a Certification and Mutual Indemnification Agreement with the <br /> County in July 1997; and <br /> <br />WHEREAS, the County Auditor has requested the City Council to adopt a resolution expressly <br /> authorizing the Agreement to be signed and binding the City to the Agreement; <br /> and <br /> <br />WHEREAS, the City is satisfied that the assessments that it has requested the County to place <br /> on the 1997/98 tax rolls meet the requirements of Proposition 218. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council ratifies the City Attomey's action that certified to the County of <br /> Alameda that the assessments that the City requested the County to place on the <br /> 1997/98 tax roll meet the requirements of Proposition 218. <br /> <br /> <br />
