PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2005-11 <br />RESOLUTION DENYING THE APPEAL OF SUMAN TRIVEDI FOR CONDITIONAL USE <br />PERMIT, AS FILED UNDER CASE PAP-75 ~PDUP-6J <br />WHEREAS, Suntan Trivedi has appealed the Zoning Administrator's denial of an application <br />for a conditional use permit to operate a. large family daycare home <br />~7-14 children ai the existing residence located at 770 St. Michael Circle; acid <br />WHEREAS, zoning for the property is YUD-I-IDR (P lanned Unit Development -High. [Density <br />Residential District; and <br />WHEREAS, at its duly noticed public hearing of March 9, 2005, the Planning Commission <br />considered all. public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WLIEREAS, projects of this nature are categorically exen-ipi from the requirements of the <br />California Enviror~rxiental Quality Act ~CEQA~; and <br />WHEREAS, the Plam~ing Commission was not able to make the necessary conditional use <br />findings for the proposed project; and <br />WHEREAS, the Planning Commission determined that the proposed. conditional use would not <br />be compatible with the existing uses in the area and does not comply with the <br />provisions of the Zoning Ordinance- <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1 . Denies the appeal of Suman Trivedi for conditional use pex'tr~it to operate a large <br />family daycare hon-ie <7-14 children at the existing residence located at <br />770 St Micl-iac;l C:ircle_ <br />Section 2. "I_his resolution shall become effective ] 5 days after its passage and adoption <br />unless appealed prior to that time. <br />1 <br />
