PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2005-01 <br />RESOLU'T'ION DELETING THE CON DITTON THA"I' BILL KOLB CONTRIBUTE $5,000 TO <br />TI-IE CITY'S URBAN FORESTRY FUND FOR THE REMOVAL OF "I'WO HERITAGE <br />TREES FROM THE SITE, AS FILED UNDER CASE PCUP-131 <br />WHEREAS, Bill Kolb has applied for conditional use permit approval to permit the interim <br />stockpiling of soil on the rear portion of a site located at I 1393 Dublin C=anyon <br />Road; and <br />WHEREAS, the applicant removed from the project site two existing trees initially determined <br />to be heritage-size, for which a contribution of $5,000 to the City's Urban <br />Forestry Fund was required; and <br />WHEREAS, at its duly noticed public hearing of December 8, 2004, after consideration of all <br />public testimony, relevant exhibits, and recommendations of City staff concerning <br />this application, the Placttiing Commission made the findings for the conditional <br />use permit and approved the conditional use permit, with the additional condition <br />that the requirement for the applicant's $5,000 contribution to the City's Urban <br />Forestry Fund be considered by the Planning Commission at its next regular <br />meeting aRer further information would be provided; and <br />WHEREAS, at its duly noticed public hearing of January 12, 2005, the Planning Commission <br />considered all public to stimony, relevant exhibits, and the City's Landscape <br />Architect determination that, following further field examination, one of the trees <br />removed was a dead heritage-size tree and the second was a marginally healthy <br />tree but non-heritage size tree; cases for which the City does not collect funds_ <br />NOW, THEI2_EFORE, THE PLANNING COMMISSION OF THE CITY OF PLF_ASAN TON <br />RESOLVES THE FOLLOWING= <br />Section 1 _ Tl-~c applicant shall not be required to coniribute $5,000 For the removal of the two <br />trees from the project site at 13393 Dublin Canyon Road <br />Section 2. Condition No. 5 of the Conditions of Approval for PCUP-13 l , which was <br />approved. at the Planning Commission meeting of December 8, 2004, shall be <br />modit3ed to remove the requirement that the applicant contribute $5,000 to the <br />City's Urban Forestry Fund, which conditions are attached herewith as Exhibit B <br />and made part of this case by reference. <br />Section 2. 'this resolution shall become effective 7 5 days after its passage and -adoption <br />unless appealed prior to that time. <br />
