CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. 1815 <br /> <br />AN ORDINANCE APPROVING THE PREANNEXATION <br />DEVELOPMENT AGREEMENT BETWEEN THE CITY OF <br />PLEASANTON AND GHC BERNAL INVESTORS, LLC <br />(GREENBRIAR HOMES COMMUNITIES, INC.) <br />REGARDING THE BERNAL PROPERTY PROJECT <br /> <br />WHEREAS, <br /> <br />Government Code Section 65864 through 65869.5 authorizes cities and counties to <br />enter into binding development agreements with persons having legal or equitable <br />iracrests in real proper~ lbr the development of such property; and <br /> <br />WHEREAS, GHC Bemal Investors LLC CGHCBI") has made application to the City for such a <br /> development agreement ±br the Bemal Properly project; and <br /> <br />WHEREAS, <br />WHEREAS, <br /> <br /> the City has certified a Final EIR for this project; and <br /> <br /> a duly noticed public hearing conceming the developmere agreement was held by <br /> the City Council on August 21,2000; and <br /> <br />WHEREAS, the City Cotmcil considered all the information presented at the public heating by <br /> GHCBI, staff; and members of the public regarding the terms of the development <br /> agreexnent. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: <br />Section 2: <br /> <br />Finds that the proposed Preannexation Development Agreement between the City <br />of Pleasanton and GHC Bemal Investors, LLC is consistent with the City's General <br />Plan and the Bernal Property Specific Plan. <br /> <br />Approves the Preannexation Development Agreement between the City of <br />Pleasanton and GHC Bemal Investors, LLC, a copy of which is attached hereto as <br />Exhibit 1 and incorporated herein by this reference; and authorizes the City <br />Manager to execute the Agreement. <br /> <br /> <br />
