<br />PLANNING COMMISSION CITY OF PLEASANT ON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-17 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF CASE RZ-94-02, THE <br />APPLICATION OF THE CITY OF PLEASANTON TO AMEND CHAPTER 18.120 <br />OF THE PLEASANTON MUNICIPAL CODE (NONCONFORMING USES) TO <br />CREATE PROVISIONS TO AMORTIZE EXISTING NONCONFORMING USES <br /> <br />WHEREAS, the City of P1easanton has applied to amend Chapter <br />18.120 of the Pleasanton Municipal Code (Nonconforming <br />Uses) to create provisions to amortize existing <br />nonconforming uses; and <br /> <br />WHEREAS, at their duly noticed public hearing of April 13, 1994, <br />the Planning Commission considered all public testimony, <br />relevant exhibits, and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />ordinance would adequately ensure that the health, <br />safety, and general welfare of the City as a whole is <br />maintained. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Recommends approval of Case RZ-94-02, the application <br />of the city of Pleasanton to amend Chapter 18.120 of the <br />Pleasanton Municipal Code (Nonconforming uses) to create <br />provisions to amortize existing nonconforming uses, as <br />shown on Exhibit "A," attached hereto and made part of <br />this case by reference. <br /> <br />section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ON THE 13TH DAY OF APRIL 1994 BY THE <br />FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />commissioners Hovingh, Mahern, Michelotti, Wright, and <br />Chairman McGuirk <br />None <br />None <br />None <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />. .. <br />
