ORDINANCE <br /> <br /> AN ORDINANCE PROBHIBITING THE HOLDING OF A PUBLIC DANCE <br />WITHIN THE LIMITS OF THE TOWN OF PEASANTON WITHOUT FIRST <br />OBTAINING PERI~ISSION THEREHeRE FRO~ THE ~OWN BOARD OF TRUSTEES <br />DEFINING L~NN~ OF i~AKING APPLICATION FOR SUCH PERMIT AND <br />PROVIDING PENALTIES FOR THE/~IOLATION OF THIS, ORDINANCE. <br /> <br /> Be it ordained by the Town Trustees of the Town of ~Pleasanton; <br /> <br /> Section l~-- It shall be unlawful ~or any person, persons, <br />firm~ or society or corporation , to give or conduct within <br />the limits of the ~own of Pleasanton any dance or other enter- <br />tainment of a like nature, where the general public is admitted. <br />whether an admission charge is made or not, without Having firs-t fl <br />obtained from the Board of Town Trustees of the Town of IPleasanton <br />a permit authorizing such a dance or entertainment. <br /> <br /> Section 2-- Such ~ermit shall be issued only after application <br />thereof has been made in writing and left with the Tow~ Elerk of <br />the said Board. ~uch application shall contain the name or names <br />of the persons responsible for the dance or entertainment, or in <br />the case of a lodge, corporation or society, the name or names <br />of the committee in charge of the same; which person or persons <br />shall at all times be ~eld liable for the conduct of the dance. <br />The application shall also set .forth the hall or other place ~n <br />which the dance is to be held, the date on which it is to be held. <br />and shal~ contain a statement and promise that such police protection <br />as the board or town marshal shall deem necessary shall be employed <br />to maintain peace for the occasion. Such police protection to be <br />at the expenseof the applicant. ~uch application shall be sworn <br />to before the twon clerk or other officer authorized to admimister <br />oaths. <br /> <br /> Section 3-- The Board of ~own Trustees, upon receipt of such <br />application, may , it in its descretion, such dance or entertainment <br />is in accord with the best interests of the town and citizens thereof; <br />and if said beard besatisfied that the dance will be conducted in <br />accordance with the statements contained in the application , direct <br />the ~own Clerk to issue the necessary permit under the s%al of the <br />town. <br /> <br /> Section 4-- It shall be the duty of the ~own marshal to demand <br />of every ~erson, in charge of any dance or similar entertainment <br />~ucha permit. and if the same is not~roduced to immediately close <br />such dance a~d not ~ermit the~same.;te ~n~inue. <br /> <br /> Section 5-- It is s~pcifically provided, however, that none of <br />the provisions of this ordinance shall apply to such social dances <br />or similar affairs ~iven under the auspices of local frateranl or <br />other socities, schools, or churches, whe~e o~ly members of such <br />organizations attend. <br /> <br /> Section 6-- Violation of any of the p~ovisions of this ordinance, <br />upon conviction thereof, shall be pinish~by a fine of not less than <br />five dollars, not more tha~ one hundred dollars, or by imprisonment <br /> <br /> <br />
