CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1915 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF DAVID <br /> BOGSTAD/LOVING & CAMPOS ARCHITECTS AND JEFF WOODS/ <br /> BLACK MOUNTAIN DEVELOPMENT FOR PLANNED UNIT <br /> DEVELOPMENT MAJOR MODIFICATION, AS FILED UNDER <br /> CASE PUD-98-16-3M <br /> <br />WHEREAS, David Bogstad/Loving & Campos Architects and Jeff Woods/Black <br /> Mountain Development have applied for a major modification to an <br /> approved Planned Unit Development (PUD) development plan to modify <br /> the design guidelines and review processes for the future homes of the <br /> Mariposa Ranch development by the Callippe Preserve Golf Course; and <br /> <br />WHEREAS, zoning for the property is PUD-GC and LDR (Planned Unit Development - <br /> Golf Course and Low Density Residential) District; and <br /> <br />WHEREAS, an environmental review for the proposed project was undertaken with the <br /> Environmental Impact Report (EIR) for the Happy Valley Specific Plan, <br /> certified by the City Council on June 16, 1998; and <br /> <br />WHEREAS, there are no substantial changes to the project or to the circumstances under <br /> which the project is undertaken that involve new significant environmental <br /> effects or substantially increase the severity of previously identified effects, <br /> and there is no new information of substantial importance not known at the <br /> time the EIR was certified regarding the projects or its effects, mitigation <br /> measures, or alternatives; therefore, no additional environmental <br /> documentation was prepared for this application; and <br /> <br />WHEREAS, at its meeting of March 9, 2005, the Planning Commission recommended <br /> approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on April 5, 2005; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with <br /> the General Plan policies and the purposes of the PUD ordinance of the <br /> City of Pleasanton; and <br /> <br /> <br />
