<br />PLANNING COHHISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-12 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO <br />AN APPROVED PUD DEVELOPMENT PLAN AS FILED UNDER CASE <br />PUD-93-2-1M, RUBY HILL DEVELOPMENT JOINT VENTURE, L.P. <br /> <br />WHEREAS, Ruby Hill Development Joint Venture, L.P., has applied <br />for a major modification to an approved PUD development <br />plan for the Ruby Hill development to allow revisions <br />to the approved land plan; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned unit <br />Development) - A/OS/LDR (Agricultural/Open Space/Low <br />Density Residential) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of February 8, <br />1995, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared for the <br />Ruby Hill development plan with the County of Alameda <br />acting as Lead Agency. The proposed modifications are <br />not in conflict with the EIR or the adopted mitigation <br />measures; therefore, no new environmental document was <br />prepared for this application; and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />modifications maintain the original intent of the plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Recommends approval of Case PUD-93-2-1M, the <br />application of Ruby Hill Development Joint venture, <br />L.P., for a major modification to an approved PUD <br />development plan for the Ruby Hill development to allow <br />revisions to the approved land plan, subject to the <br />conditions shown on Exhibit "B," attached hereto and <br />made part of this case by reference. <br /> <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />
