PLANNING COHHISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-95-12 RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO AN APPROVED PUD DEVELOPMENT PLAN AS FILED UNDER CASE PUD-93-2-1M, RUBY HILL DEVELOPMENT JOINT VENTURE, L.P. WHEREAS, Ruby Hill Development Joint Venture, L.P., has applied for a major modification to an approved PUD development plan for the Ruby Hill development to allow revisions to the approved land plan; and WHEREAS, zoning for the property is PUD (Planned unit Development) - A/OS/LDR (Agricultural/Open Space/Low Density Residential) District; and WHEREAS, at their duly noticed public hearing of February 8, 1995, the Planning commission considered all public testimony, relevant exhibits and recommendations of the city staff concerning this application; and WHEREAS, an Environmental Impact Report was prepared for the Ruby Hill development plan with the County of Alameda acting as Lead Agency. The proposed modifications are not in conflict with the EIR or the adopted mitigation measures; therefore, no new environmental document was prepared for this application; and WHEREAS, the Planning commission determined that the proposed modifications maintain the original intent of the plan. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Recommends approval of Case PUD-93-2-1M, the application of Ruby Hill Development Joint venture, L.P., for a major modification to an approved PUD development plan for the Ruby Hill development to allow revisions to the approved land plan, subject to the conditions shown on Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective immediately upon its passage and adoption.
