<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-23 <br /> <br />RESOLUTION RECOMMENDING TO THE CITY TO ENACT <br />AN INTERIM ORDINANCE ESTABLISHING A MORATORIUM <br />UNTIL THE GENERAL PLAN UPDATE IS COMPLETED. <br /> <br />WHEREAS, California Government Code Section 65858 provides statutory authority and time <br />limits for interim ordinances, commonly called a moratorium, prohibiting uses <br />which may be in conflict with a contemplated general plan, specific plan, or <br />zoning proposal which a city is studying or plans to study; and <br /> <br />WHEREAS, The City is in the process of updating its General Plan; and <br /> <br />WHEREAS, the Planning Commission has received numerous requests from its citizens to <br />recommend a moratorium on development projects until the General Plan Update <br />is completed; and <br /> <br />WHEREAS, at its duly noticed public hearing of March 24, 2004, the Planning Commission <br />considered all public testimony and relevant information from City staff <br />concerning this matter. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Section 2. <br /> <br />Section 2. <br /> <br />Pursuant to Government Code Section 65858, the Planning Commission finds that <br />there exists a current and immediate threat to the public health, safety, and <br />welfare of its citizens due to traffic, public safety, grading, and other quality-of- <br />life issues as discussed during the public hearing and by the Commission at its <br />meeting, and that the approval of any new commercial, residential, or industrial <br />development that generates greater than 200 daily trips would result in that threat <br />to public health, safety, and welfare. <br /> <br />The Planning Commission further finds that a temporary moratorium will not <br />adversely affect the orderly development of property or the preservation of <br />property values. <br /> <br />Recommends to the City Council to enact an interim ordinance establishing a <br />moratorium until the General Plan Update is completed, which would apply to <br />any new commercial, residential, or industrial development that generates greater <br />than 200 daily trips, with the exemption of the Happy Valley Specific Plan, the <br />Vineyard Corridor Specific Plan, and the Downtown Specific Plan areas, as these <br />Specific Plan areas were recently planned and had mitigated issues concerning <br />traffic, public safety, and grading. <br />
