<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-16 <br /> <br />RESOLUTION DENYING THE APPEAL OF WILLIAM MUA T FOR ADMINISTRATIVE DESIGN <br />REVIEW APPROVAL, AS FILED UNDER CASE P AP-60 (P ADR-909) <br /> <br />WHEREAS, William Muat has appealed the Zoning Administrator's approval of Case PADR-909, the <br />application of Robert D' Arcy to construct a seven-foot high redwood fence along the <br />common side property line at 3671 Olympic Court North and 3657 Olympic Court North; <br />and <br /> <br />WHEREAS, zoning for the properties is R-I-6,500 (Single-Family Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of February 25, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe City staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings for a seven-foot high fence: <br /> <br />I. The application conforms with the objectives of the Pleasanton Zoning <br />Ordinance. <br /> <br />The proposed fence meets all of the necessary yard requirements as outlined in the <br />Pleasanton Zoning Ordinance. In addition, the fence will not detrimentally affect the <br />public health, safety, peace, comfort, or general welfare. Therefore, this finding can be <br />made. <br /> <br />2. The application assists in providing privacy, in attenuating sound transmission, <br />and/or in reducing other annoyance from neighboring properties. <br /> <br />The proposed fence will provide additional privacy and noise attenuation for the <br />applicant. Therefore, this finding can be made. <br /> <br />3. The application does not significantly impact upon the aesthetics and safety of the <br />neighborhood nor the light and air to all affected properties. <br /> <br />The proposed fence would be constructed with material to match the existing fence <br />material in the neighborhood. The total height of the fence would not exceed seven feet <br />as measured from the existing grade prior to the construction of the retaining wall and <br />addition offill. The design of the fence is acceptable. In addition, the fence does not <br />detrimentally affect the light and air of the neighboring properties, nor creates a traffic <br />sight obstruction. Therefore, this finding can be made. <br />
