<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-07 <br /> <br />RESOLUTION DENYING THE APPLICATION OF GREENBRIAR HOMES COMMUNITIES TO <br />ESTABLISH A WALL-FENCE ENTRY AT THE BERNAL PROPERTY <br /> <br />WHEREAS, Greenbriar Homes Communities has applied to establish a wall-fence entry feature <br />flanking the West Lagoon Road entrance to the Bernal Property at Bernal Avenue on <br />property owned by the City of Pleasanton; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of January 14,2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the use of a City-owned parcel for the entry <br />feature was a possible inappropriate use of City property, raised long-term maintenance <br />issues, and was a technical "breach" of the Phase II Specific Plan requirement that a full <br />plan be adopted prior to any such uses, and, therefore, the installation of the proposed <br />entry monument is premature. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies the application of Greenbriar Homes Communities to establish a wall-fence entry <br />feature flanking the West Lagoon Road entrance to the Bernal Property at Bernal Avenue <br />on property owned by the City of Pleasant on. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption unless <br />appealed prior to that time. <br />
