PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-2004-07 RESOLUTION DENYING THE APPLICATION OF GREENBRIAR HOMES COMMUNITIES TO ESTABLISH A WALL-FENCE ENTRY AT THE BERNAL PROPERTY WHEREAS, Greenbriar Homes Communities has applied to establish a wall-fence entry feature flanking the West Lagoon Road entrance to the Bernal Property at Bernal Avenue on property owned by the City of Pleasanton; and WHEREAS, zoning for the property is PUD (Planned Unit Development) District; and WHEREAS, at its duly noticed public hearing of January 14,2004, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that the use of a City-owned parcel for the entry feature was a possible inappropriate use of City property, raised long-term maintenance issues, and was a technical "breach" of the Phase II Specific Plan requirement that a full plan be adopted prior to any such uses, and, therefore, the installation of the proposed entry monument is premature. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Denies the application of Greenbriar Homes Communities to establish a wall-fence entry feature flanking the West Lagoon Road entrance to the Bernal Property at Bernal Avenue on property owned by the City of Pleasant on. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
