<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-03 <br /> <br />RESOLUTION DENYING THE APPEAL OF BERNI AND HERMINE HAFKER, <br />AS FILED UNDER CASE PAP-56 <br /> <br />WHEREAS, Berni and Hermine Hafker have appealed the Zoning Administrator's determination that <br />a three-lot subdivision of the Hafker property located at 565 Sycamore Creek Way would <br />require an amendment to the North Sycamore Specific Plan, dated June 1992, pursuant to <br />the North Sycamore Specific Plan EIR, dated February 1991; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of January 14, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City staff <br />concerning this appeal; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed development exceeds the two <br />dwelling unit per acre maximum, thereby rendering it inconsistent with the North <br />Sycamore Specific Plan as it applies to this property; and <br /> <br />WHEREAS, the matter under consideration is exempt from the requirements of the California <br />Environmental Quality Act (CEQA). <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies Case PAP-56, the appeal of Berni and Hermine Hafker of the Zoning <br />Administrator's determination that a three-lot subdivision of the Hafker property located <br />at 565 Sycamore Creek Way would require an amendment to the North Sycamore <br />Specific Plan, thus affirming that the North Sycamore Specific Plan allows two lots on <br />the property. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption unless <br />appealed prior to that time. <br />
