PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-2004-03 RESOLUTION DENYING THE APPEAL OF BERNI AND HERMINE HAFKER, AS FILED UNDER CASE PAP-56 WHEREAS, Berni and Hermine Hafker have appealed the Zoning Administrator's determination that a three-lot subdivision of the Hafker property located at 565 Sycamore Creek Way would require an amendment to the North Sycamore Specific Plan, dated June 1992, pursuant to the North Sycamore Specific Plan EIR, dated February 1991; and WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low Density Residential) District; and WHEREAS, at its duly noticed public hearing of January 14, 2004, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this appeal; and WHEREAS, the Planning Commission determined that the proposed development exceeds the two dwelling unit per acre maximum, thereby rendering it inconsistent with the North Sycamore Specific Plan as it applies to this property; and WHEREAS, the matter under consideration is exempt from the requirements of the California Environmental Quality Act (CEQA). NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Denies Case PAP-56, the appeal of Berni and Hermine Hafker of the Zoning Administrator's determination that a three-lot subdivision of the Hafker property located at 565 Sycamore Creek Way would require an amendment to the North Sycamore Specific Plan, thus affirming that the North Sycamore Specific Plan allows two lots on the property. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
