Since the writing of the City Council staff report, the applicant has requested to remain open later on four additional days on or near certain holidays: March 17th (St. Patrick's Day) July 3rd The Wednesday before Thanksgiving Day December 23ra The applicant has indicated that these tend to be very busy nights and that it would be better if she had extra time for patrons to disperse slowly rather than have everyone exit at the same time. Staffbelieves that the proposed request is acceptable and would not adversely impact the adjacent neighbors. Therefore, staffrecommends that Condition No. 2 of Planning Commission Resolution No. PC-2004-69 be modified to read as follows: Except as noted below, the operation of the restaurant/bar shall be limited to the following hours: 11:30 a.m. to 12:00 midnight, Monday through Thursday; 11:30 a.m. to 1:00 a.m., Fridays and Saturdays; and 11:30 a.m. to 11:00 p.m. on Sundays. The restaurant/bar may remain open until 1:00 a.m. on March 17th (St. Patrick's Day), July 3fa, the Wednesday before Thanksgiving Day, December 23rd, and New Year's Eve each year. The outdoor dining on the south (rear) of the building shall close and not be used after 9:45 p.m. daily. The outdoor dining area on the eastern side of the building shall close and not be used after 11:00 p.m., Sunday through Thursday and 1:00 a.m. on Fridays and Saturdays. The restaurant/bar employees shall not dispose of waste or recyclables in the trash enclosure area prior to 8:00 a.m. or after 10:00 p.m. SR 05:023 Cover Page
