<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-96-21 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE NEGATIVE <br />DECLARATION FOR THE APPLICATION OF RAYMUND <br />VILLANUEV AIIN-N-OUT BURGER, AS FILED UNDER CASE <br />PUD-96-05/UP-96-0S <br /> <br />WHEREAS, Raymund Villanueva/IN-N-OUT BURGER has submitted an application for a <br />conditional use permit and development plan approval to construct a new, <br />approximately 2,919 square foot, fast-food restaurant with drive-through, and for <br />development plan approval for a 6,300 square foot retail building pad on the <br />former Budget Rent-a-Car and Guaranty R.V. Center site at 4011 Pimlico Drive; <br />and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C (Commercial) <br />District; and <br /> <br />WHEREAS, at its meeting of April 10, 1996, the Planning Commission received a proposed <br />negative declaration for Case PUD-96-0S/UP-96-0S; and <br /> <br />WHEREAS, the Planning Commission has received and reviewed the Initial Study dated <br />March IS, 1996, and received the recommendations of staff; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time the public was given the <br />opportunity to comment on the environmental impacts of the proposal; and <br /> <br />WHEREAS, the Planning Commission has reviewed the potential impacts in accordance with <br />the applicable state and local guidelines governing the preparation of Negative <br />Declarations and Environmental Impact Reports; and <br /> <br />WHEREAS, the Planning Commission finds that approval of the proposed project would not <br />have any significant adverse effects on the environment. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Recommends approval of the Negative Declaration prepared for Case <br />PUD-96-05/UP-96-0S, the application of Raymund Villanueva/IN-N-OUT <br />BURGER for a conditional use permit and development plan approval to <br />construct a new, approximately 2,919 square foot, fast-food restaurant with <br />drive-through, and for development plan approval for a 6,300 square foot retail <br />building pad on the former Budget Rent-a-Car and Guaranty R.V. Center site at <br />4011 Pimlico Drive. <br />
