<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-17 <br /> <br />RESOLUTION APPROVING CASE AP-96-01, THEREBY DENYING THE <br />APPLICATION OF SAFEW A Y, INC. AND ESSENAR INVESTMENTS, INC., AS <br />FILED UNDER CASE Z-95-21 7N-95-1 8 <br /> <br />WHEREAS, the Zoning Administrator approved Case Z-95-217N-95-18, the application of <br />Safeway, Inc. and Essenar Investments, Inc., for a variance and design review <br />approval to allow the construction for two new, 14' 0" tall freestanding signs on <br />the Amador Plaza shopping center, one facing Santa Rita Road and one facing <br />V alley Avenue, located at 1677 to 1797 Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is CoN (Neighborhood Commercial) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the decision was <br />appealed by Planning Commissioner Hovingh; and <br /> <br />WHEREAS, at their duly noticed public hearing of March 13, 1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that granting approval of this sign would <br />establish a precedent which would encourage the practice of exceeding the <br />standards of the Municipal Code regarding number, height, and sign area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1 <br /> <br />Approves Case AP-96-01, thereby denying Case Z-95-217N-95-18, the <br />application of Safeway, Inc. and Essenar Investments, Inc., for a variance and <br />design review approval to allow the construction for two new, 14' 0" tall <br />freestanding signs on the Amador Plaza shopping center, one facing Santa Rita <br />Road and one facing Valley A venue, located at 1677 to 1797 Santa Rita Road. <br /> <br />Section 2. <br /> <br />This resolution shall become effective immediately upon its passage and adoption. <br />
