1 <br /> <br />AGREEMENT FOR ACCEPTANCE OF DONATION OF ARTWORK <br />FOR DISPLAY IN PUBLIC PLACES <br /> <br /> THIS AGREEMENT FOR ACCEPTANCE OF THE DONATION OF ARTWORK FOR DISPLAY <br />IN PUBLIC PLACES (“Agreement”) is made and entered into on this 16th day of June 2025 by the <br />CITY OF PLEASANTON, a municipal corporation ("City"). and Rotary Club of Pleasanton <br />("Donor"), whose address is P.O. Box 352, Pleasanton, CA and telephone number is (925) 785-0549. <br /> <br />RECITALS <br /> <br />WHEREAS, the purpose of the City’s Art in Public Places program is to promote the acquisition, <br />construction and installment of works of public art that will foster creativity, engender civic pride, <br />encourage a sense of community, and enrich the lives of our citizens (Pleasanton Municipal Code (§ <br />13.16.020 Art in Public Places. Purpose and Goals.) <br /> <br />WHEREAS, the Donor has submitted a proposal to donate to the City the following piece of art <br />(“Artwork”) as follows: <br />• Title of Artwork: Hope and Promise <br />• Artist: Leta Eydelberg <br />• Medium/Materials: Artwork painted on marine-grade plywood, metal frame <br />• Dimensions: Artwork: 6’x 4’, Frame: 76” x 72” <br />• Location: To be installed at Rotary Park, 890 Main Street, Pleasanton CA <br /> <br />WHEREAS, on December 17, 2024 the City Council approved the City’s acceptance of donation <br />of the Artwork. <br />NOW THEREFORE, in consideration of the mutual covenants and conditions in this Agreement, City <br />and Donor agree as follows: <br /> <br />1. Donation and Acceptance. The Donor hereby conveys by donation of the Artwork and its <br />legal title to the City, and the City hereby accepts the donation of the Artwork under the <br />terms, qualifications, and conditions as set forth in this Agreement. <br /> <br />a. The Donor certifies that the Artwork is a unique work of art created by Leta Eydelberg <br />and is not subject to third-party claims of royalties or copyright or trademark <br />infringement. <br /> <br />b. The Donor has provided documentation establishing themselves as the clear and <br />unencumbered title holder of the artwork as required by the Pleasanton Municipal Code (§ <br />13.16.070.
