THE CITY OF <br /> <br />pL£AS&NTON <br /> <br />4Q <br /> <br />City Council <br />Staff Report <br /> <br /> January 4, 2005 <br />City Attorney's Office <br /> <br />SUBJECT: <br /> <br />AUTHORIZATION TO SUBMIT A LETTER TO THE <br />CALIFORNIA SUPREME COURT REQUESTING THAT THE <br />COURT GRANT REVIEW CONCERNING LITIGATION <br />INTERPRETING ALAMEDA COUNTY MEASURE D <br /> <br />STAFF RECOMMENDATION: <br /> <br />Authorize the City Attorney to send a letter to the California Supreme <br />Court in support of the efforts of Save Our Sunol to have its pending <br />litigation reviewed by the Supreme Court. <br /> <br />SUMMARY: <br /> <br />Alameda County voters approved Measure D in 2000. Measure D <br />amended the County General Plan, established urban growth boundaries <br />and provides that no new quarries may be approved by the County outside <br />the urban growth boundaries without voter approval. The City and <br />County of San Francisco, which has substantial land holdings in the Sunol <br />area, proposed to lease over 100 acres for a quarrying operation, the <br />boundaries of which are outside the urban growth boundaries. Residents <br />within Sunol (Save Our Sunol) filed suit to enjoin the quarry's operation. <br />The residents lost at the trial court and at the court of appeal and now will <br />ask the California Supreme Court to review the case. (The Supreme <br />Court's review is discretionary.) Council has asked that this item be <br />placed on its agenda to consider whether Pleasanton should submit a letter <br />to the Supreme Court in support of the efforts of the Sunol residents to <br />have the Court grant review. <br /> <br />SR:05:021 <br />Page 1 <br /> <br /> <br />
