CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1912 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF FAIRLAND <br />INVESTMENT, INC. FOR PUD MODIFICATION TO THE STANLEY <br />BUSINESS PARK PUD DEVELOPMENT PLAN, AS FILED UNDER <br />CASE PUD-81-25-6M <br /> <br />WHEREAS, <br /> <br />Fairland Investment, Inc. has applied for a modification to the approved <br />Planned Unit Development (PUD) development plan for Stanley Business <br />Park to allow alcoholic beverage sales from the convenience market to be <br />located at 3121 Bernal Avenue and 3581 Utah Street; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - <br /> Commercial) District; and <br /> <br />WHEREAS, <br /> <br />based on the Initial Environmental Study and pursuant to Resolution No. <br />04-080, the City Council adopted the Negative Declaration for the proposed <br />project at its meeting of October 19, 2004; and <br /> <br />WHEREAS, <br /> <br />pursuant to Resolution No. 04-081, the City Council approved the <br />application of Fairland Investment, Inc. for design review and conditional <br />use permit of a self-service gasoline station consisting of eight fuel <br />dispensers, a drive-through carwash, and a 3,600-square-foot convenience <br />market at the subject site; and <br /> <br />WHEREAS, <br /> <br />the City Council received the Planning Commission's positive <br />recommendations for approval of the PUD development plan modification <br />for the subject site; and <br /> <br />WHEREAS, <br /> <br />the City Council finds that the PUD modification is consistent with the <br />General Plan policies and the purposes of the PUD ordinance of the City of <br />Pleasanton. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br /> <br />
