THE CITY OF <br /> PLEASANTON. <br /> First Amendment to Subdivision Agreement <br /> Parcel Map 10539, 11300 Dublin Canyon Road <br /> Pleasanton, Alameda County, California <br /> This First Amendment to Subdivision Agreement (the "First Amendment") is made and <br /> entered into on February 14, 2024, by and between The Greek Orthodox Church of <br /> the Resurrection ("Church"), and the City of Pleasanton ("City"). <br /> RECITALS <br /> WHEREAS, on February 24, 2022, Church and City entered into a Subdivision <br /> Agreement ("Agreement") whereby Church agreed to construct the public <br /> infrastructure as shown on the plans for Parcel Map 10539 and in accordance with <br /> a major modification to Planned Unit Development (PUD-114) and a minor <br /> subdivision as approved by Pleasanton City Council Ordinance 2220 for the <br /> approximately 4.3-acre of the Pleasant View Church of Christ property located at <br /> 11300 Dublin Canyon Road. <br /> WHEREAS, on April 8, 2022 Pleasant View Church of Christ assigned all rights and <br /> obligations of said City approval to Church according to the document titled Grant <br /> Deed hereto attached as Exhibit A. <br /> WHEREAS, Church and City now wish to modify the Subdivision Agreement by <br /> executing this First Amendment to clarify the rights and obligations assigned to <br /> Church. <br /> NOW, THEREFORE, in consideration of the faithful performance of the promises, <br /> terms, conditions, and covenants set forth herein, the Subdivision Agreement is <br /> hereby amended as follows (StFiGken language is hereby deleted; bolded and <br /> underlined language is hereby added): <br /> 1. The first paragraph of Paragraph 1 shall be amended as follows: "Time of <br /> Essence. Time is of the essence in the performance of this Agreement. The <br /> work and improvements required by this Agreement to be completed by <br /> Subdivider shall be completed within two (2) years from the <br /> date of t#is the First Amendment to Subdivision Improvement <br /> Agreement." <br /> 2. All other terms and conditions of the original Subdivision Improvement <br /> Agreement shall remain in full force and effect. <br /> 3. This First Amendment may be executed in multiple counterparts, each of which <br /> shall be an original and all of which together shall constitute one agreement. <br /> Counterparts may be delivered via facsimile, electronic mail (including pdf or any <br /> 1 of 2 <br /> L � <br />
