4
THE CITY OF
CITY COUNCIL AGENDA REPORT
PLEASANTON.
June 20, 2023
Engineering
TITLE: ADOPT RESOLUTIONS APPROVING THE 2023/24 ANNUAL
ASSESSMENTS FOR LANDSCAPE MAINTENANCE DISTRICTS 1984-1
(PONDEROSA-DEL PRADO), 1993-1 (WINDSOR), 1993-2 (BONDE
RANCH), 1994-1 (OAK TREE FARM)AND 1995-1 (MOLLER RANCH)
SUMMARY
The annual assessments forthe maintenance of the Landscape Maintenance Districts
(LMDs) in the Ponderosa-Del Prado,Windsor, Bonde Ranch, Oak Tree Farm, and Moller
Ranch subdivisions have been calculated for Fiscal Year 2023/24.All districts are
underfunded as assessments have not been increased since the passage of Proposition
218 in 1996. In addition, reserves for capital replacement are limited or non-existent.
Staff hired a consultant that specializes in LMDs, SCI Consulting Group, to review the
Bonde Ranch and Windsor LMDs to determine appropriate assessments for future
years, perform public outreach to discuss the requirements and potential assessments,
and hold a Proposition 218 compliant vote as is necessary for an increase in
assessments. Voting for the Bonde Ranch and Windsor LMDs was scheduled for last
fiscal year, butthe vote was put on hold due to opposition. Bonde Ranch property
owners opposed any proposed increase while Windsor property owners expressed an
interest in a more comprehensive discussion regarding the assessment. Staff conducted
further outreach with Windsor property owners this past year and worked with the HOA
Board to pursue an alternative route that the HOA would approve. The HOA Board
provided a letter to the City stating its intent to take over the routine plant maintenance
and water costs starting in January 2024, which equates to approximately$17,000
annually in cost reductions to the LMD.
As such, all assessment amounts are proposed to remain unchanged until such time that
the analysis and a Proposition 218 compliant vote can take place.
RECOMMENDATION
1. Open and hold a public hearing to receive comments regarding the levy of annual
assessments for each of the Landscape Maintenance Districts.
2. Adopt a resolution confirming the Engineer's Report and levying assessments for
each of the Landscape Maintenance Districts.
3. Appropriate $11,560 from the applicable City funds (General Fund, Water Fund
and Sewer Fund)to the respective Landscape Maintenance Districts.
