9 <br /> THE CITY OF <br /> 0—F 1"-%M" I CITY COUNCIL AGENDA REPORT <br /> PLEASANTON. <br /> May 16, 2023 <br /> Engineering <br /> TITLE: ADOPT RESOLUTIONS APPROVING THE ENGINEER'S REPORTS FOR <br /> LANDSCAPE MAINTENANCE DISTRICTS 1984-1 (PONDEROSA-DEL <br /> PRADO), 1993-1 (WINDSOR), 1993-2 (BONDE RANCH), 1994-1 (OAK <br /> TREE FARM), AND 1995-1 (MOLLER RANCH), DECLARING THE CITY'S <br /> INTENTION TO ASSESS THE PROPERTIES FOR THE COST TO <br /> OPERATE AND MAINTAIN THE DISTRICTS AND SETTING JUNE 20, <br /> 2023, AT 7 P.M. AS THE DATE AND TIME FOR THE PUBLIC HEARING <br /> SUMMARY <br /> The annual Engineer's Reports for the maintenance of the Landscape Maintenance <br /> Districts (LMDs) in the Ponderosa-Del Prado, Windsor, Bonde Ranch, Oak Tree Farm, <br /> and Moller Ranch subdivisions have been completed for FY 2023/24. The Engineer's <br /> Reports determine the assessment that will be levied against each property owner <br /> within each LMD for the electrical costs, maintenance, and irrigation for the special <br /> district landscaping installed as part of each development. All assessment amounts <br /> remain unchanged from previous years. However, this is unsustainable as costs have <br /> increased, which has resulted in the level of maintenance decreasing significantly since <br /> the districts were created. In addition, reserves for capital replacement are limited or <br /> non-existent. <br /> Staff hired a consultant that specializes in LMDs — SCI Consulting Group — to determine <br /> appropriate assessments for future years, perform public outreach to discuss the <br /> requirements and potential assessments, and hold a Proposition 218 compliant vote as <br /> is necessary for an increase in assessments. Both last and this year's scheduled voting <br /> for the Bonde Ranch and Windsor LMDs were put on hold due to opposition and/or <br /> concerns from property owners. After the feedback staff received in early 2022 from the <br /> Windsor and Bonde Ranch LMDs, staff focused on outreach for the Windsor LMD for <br /> 2022/23. The Windsor HOA has indicated that it will take over routine landscape <br /> maintenance and water costs starting in 2024 to address the funding issues for the <br /> LMD, which is reflected in the Windsor LMD Engineer's Report. <br /> It is recommended the City Council approve the Engineer's Report for each LMD, <br /> declare the intention to levy and collect assessments, schedule a public hearing for 7 <br /> p.m. on June 20, 2023, to receive testimony from those that will be subject to the <br /> assessments, and direct the City Clerk to advertise a Notice of Annual Hearing ten days <br /> prior to the hearing. <br />
