10 <br /> THE CITY OF <br /> -.. •iii:iii <br /> L�E�S�4NTON CITY COUNCIL AGENDA REPORT <br /> PJanuary 17, 2023 <br /> Operations Services <br /> TITLE: ADOPT A RESOLUTION APPROVING A SUBLICENSE AGREEMENT WITH <br /> THE EAST BAY REGIONAL PARK DISTRICT FOR A SECTION OF THE <br /> IRON HORSE TRAIL LOCATED BETWEEN SANTA RITA ROAD AND <br /> VALLEY AVENUE <br /> SUMMARY <br /> The City and the East Bay Regional Park District (District) for many years have had an <br /> informal understanding that the City is responsible for the ongoing maintenance of the <br /> paved trail and landscape improvements of the segment of the Iron Horse Trail (IHT) <br /> located between Santa Rita Road and Valley Avenue. The City and the District seek to <br /> clarify maintenance responsibilities regarding the paved trail and landscape <br /> improvements on this section of the IHT. The County of Alameda (County) owns the <br /> former Southern Pacific Railroad corridor and the District is under a License Agreement <br /> with the County to operate the Iron Horse Regional Trail between Interstate 580 and <br /> Valley Ave. The proposed Sublicense Agreement will formalize the City and District's <br /> arrangement and clarify maintenance responsibilities of the IHT between Santa Rita <br /> Road and Valley Avenue. <br /> The term of this Sublicense Agreement shall run concurrently with the License <br /> Agreement between the County and District, which commenced on December 15, 1998, <br /> for an initial twenty-five years and extended another ten years until December 14, 2033. <br /> RECOMMENDATION <br /> Staff recommends the City Council adopt a resolution (Attachment 1) to approve the <br /> Iron Horse Trail Sublicense Agreement (Attachment 2) with East Bay Regional Park <br /> District and authorize the City Manager to sign all necessary documents. <br /> FINANCIAL STATEMENT <br /> There is no fiscal impact associated with approving the new Sublicense Agreement. The <br /> maintenance items described in the new Sublicense Agreement are already <br /> programmed and accounted for based on the previous informal understanding of <br /> maintenance responsibilities with the District. <br /> Page 1 of 3 <br />
