CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1909 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF BERNI <br />HAFKER FOR PLANNED UNIT DEVELOPMENT MAJOR <br />MODIFICATION AND DEVELOPMENT PLAN APPROVALS, AS FILED <br />UNDER CASE PUD-96-4-1M <br /> <br />WHEREAS, <br /> <br />Berni Hafker has applied for major modification to an approved Planned <br />Unit Development development plan, PUD-96-4, and for development plan <br />approval to allow the subdivision of the 1.29~acre property at <br />565 Sycamore Creek Way into a three-lot custom home development; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low <br /> Density Residential) District; and <br /> <br />WHEREAS, <br /> <br />an Environmental Impact Report (EIR) was prepared for the North <br />Sycamore Specific Plan and certified by the City Council on <br />February 1991; and <br /> <br />WHEREAS, <br /> <br />the California Environmental Quality Act (CEQA) specifies that individual <br />residential development projects that are prepared pursuant to the <br />requirements of an adopted Specific Plan; for which an EIR has been <br />prepared and certified, are exempt from additional environmental review; <br />and the proposed specific plan amendment to add one lot on this property <br />would be a minor change in land use regulations and, therefore, no <br />environmental document accompanies the proposed PUD development <br />plan; and <br /> <br />WHEREAS, at its meeting of August 25, 2004, the Planning Commission recommended <br /> approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on September 21, 2004; and <br /> <br /> <br />
