Box 520 <br />Pleasanton, Califomia 94566 <br /> <br /> of Document Recorded <br />on JUL ~. 3 ~00~ <br />asNo. <br />Has not been compared with Original. <br /> ALAMEDA COUNTY RECORDER <br /> <br />PURSUANTTO <br /> <br />G.C. 27383 & <br /> G.C, 6103 <br /> <br />LICENSE AND LANDSCAPING MAINTENANCE AGREEMENT <br /> <br /> THIS LICENSE AND LANDSCAPING MAINTENANCE AGREEMENT is <br />made and entered into this 1~ th day of ~ u ~-~{ ,2004, by and <br />between the City of Pleasanton ("City") and Diana Lynn O'Connor ("Developer"). <br /> <br />RECITALS <br /> <br /> WHEREAS, Developer owns real property commonly known as 4330 First <br />Street, Pleasanton, California, ("Property") and more particularly described in Exhibit A. <br />which is attached and incorporated into this Agreement by this reference; <br /> <br /> WHEREAS, on July 2, 2004, the City approved PV-105 and PDR-372 for a <br />variance and design review approval ora 2000 square foot, two-story residence with <br />detached garage on Property ("Project"); <br /> <br /> WHEREAS, Condition 11 of the Conditions of Approval for the Project requires <br />the Developer to enter into an agreement with the City to maintain all landscaped areas <br />along First Street within the City right of way which are included as part of this Project <br />("City Right of Way"); and <br /> <br /> NOW, THEREFORE, in consideration of the mutual promises contained in this <br />Agreement, the parties agree as follows: <br /> <br /> 1. Purpose. The purpose of this Agreement is to: a) permit Developer to <br />enter onto the City Right of Way to maintain the Project's landscaped areas; b) assure the <br />installation and continued maintenance of landscaping in accordance with the City- <br />approved landscape plan for the Project. <br /> <br /> 2. License. City grants Developer a revocable license to maintain the <br />landscaping in the City Right of Way. Any suspension or revocation of this license shall <br />suspend Developer's obligation to maintain the landscaping in the City Right of Way. <br />Prior to the initial installation and any future trenching in the City Right of Way, <br />Developer shall obtain an Encreacb_ment Permit from the City's Public Works <br />Department. <br /> <br />Copy <br /> <br /> <br />
