7 <br /> THE ° <br /> CITY OF <br /> i <br /> ° ° -'-r CITY COUNCIL AGENDA REPORT <br /> L- AT6SJO <br /> November 2, 2021 <br /> Community Development Department <br /> Planning <br /> TITLE: CONSIDER ADOPTION OF A RESOLUTION APPROVING A <br /> PREANNEXATION AGREEMENT WITH ZOLU LLC FOR A SANITARY <br /> SEWER CONNECTION FOR AN EXISTING RESIDENCE WITH A FAILING <br /> SEPTIC SYSTEM LOCATED AT 871 SYCAMORE ROAD IN <br /> UNINCORPORATED HAPPY VALLEY <br /> SUMMARY <br /> Zolu LLC, property owner of 871 Sycamore Road, is requesting a connection to the <br /> City's sanitary sewer system because the existing septic system that serves the <br /> residence is failing. The subject site is located in the Happy Valley Specific Plan (HVSP) <br /> area but is outside of the City limits. Prior to allowing properties outside of the City limits <br /> to connect to City utilities, the City requires the property owner enter into a <br /> preannexation agreement. If approved, a party (the City, the County or the property <br /> owner) must apply for and receive an out-of-area service agreement from the Alameda <br /> County Local Agency Formation Commission (LAFCo) as well as the approval of the <br /> Livermore-Amador Valley Water Management Agency (LAVWMA). <br /> RECOMMENDATION <br /> 1. Approve the Preannexation Agreement between Zolu LLC and the City of <br /> Pleasanton, subject to modifications approved by the City Manager and City Attorney <br /> and authorize the City Manager to execute the agreement. <br /> 2. Authorize an application be filed with LAFCo for the extension of sanitary sewer <br /> service to this property. <br /> 3. Authorize connection of 871 Sycamore Road (APN 949-0006-009) to the City's <br /> sanitary sewer system, provided: all connection work is done to the satisfaction of the <br /> City Engineer; all fees are paid and costs are borne by the property owner; and the <br /> proposed extension of City services is approved by LAFCo and LAVWMA. <br /> FINANCIAL STATEMENT <br /> The property owner would be required to pay all costs associated with extending the <br /> sanitary sewer system, including City, County, and LAFCo permitting costs, and other <br /> agency fees and connection charges. <br />
