ORDINANCE NO. 2225 <br /> AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DECLARING A LOCAL DROUGHT EMERGENCY <br /> WHEREAS, the U.S. Drought Monitor advises that 45.7% of California, including the City <br /> of Pleasanton, is experiencing "Exceptional Drought"; and <br /> WHEREAS, the Governor of California on July 8, 2021 made an emergency declaration <br /> placing a total of fifty counties, including Alameda County, under the State of California's regional <br /> drought state of emergency; and <br /> WHEREAS, the City of Pleasanton's water wholesaler, Zone 7 Water Agency, on <br /> September 1, 2021 declared a state of drought emergency within its service area and a Stage 2 <br /> water shortage with projected 2022 State Water Project water deliveries at 5% of requested <br /> allocation; and <br /> WHEREAS, the City of Pleasanton needs to be able to react quickly to this exceptional <br /> drought situation which involves the public health, safety, and welfare of the community due to <br /> intensifying drought; and <br /> WHEREAS, Municipal Code Chapter 2.44 Emergency Organization and California <br /> Government Code §§8630 et. seq. allow the City Council to proclaim a local emergency, and <br /> provides that City staff shall return to the City Council approximately every sixty (60) days to <br /> update this Local Drought Emergency situation. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds and declares that there is a current and immediate <br /> threat to the public health, safety, and welfare due to exceptional drought conditions, and this <br /> urgency ordinance must be adopted as an urgency matter necessary for the immediate <br /> preservation of the public health, safety, and welfare. <br /> SECTION 2. The City Council proclaims a Local Drought Emergency throughout the <br /> City, and areas served by the City of Pleasanton's water service, as provided in Municipal Code <br /> Chapter 2.44 and California Government Code §8630. <br /> SECTION 3. This Local Drought Emergency shall remain in effect until termination is <br /> proclaimed by the City Council. <br /> SECTION 4. This ordinance shall take effect immediately upon its passage and adoption <br /> pursuant to California Government Code §36937 as an urgency ordinance to protect the health, <br /> safety and welfare due to the extreme drought conditions and water supply constraints. <br /> SECTION 5. The adoption of this urgency ordinance is exempt from the California <br /> Environmental Quality Act ("CEQA") pursuant to California Public Resources Code §21080(b)(4) <br /> because adoption of this urgency ordinance is to mitigate an emergency. <br />
