AGREEMENT FOR INSTALLATION AND MAINTENANCE <br /> <br /> OF LANDSCAPING <br /> <br /> THIS AGREEMENT is made this 9~h <br />197 9. , between Arthur J. Mattis, Jr. <br />hereafter referred to as "Property Owner" <br /> <br />day of Augus~ , <br /> <br />and the CITY. OF PLEASANTON, <br /> <br />a municipal corporation, hereafter referred to as "City". <br /> <br /> 5~C I TA L S <br /> <br />THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br /> <br />(1) Property owner is the owner of real property in the City of <br /> <br />Pleasanton described in Exhibit "A", <br />made a part of it by this reference; <br /> <br /> (2) <br /> <br /> Review <br /> <br /> (3) <br /> <br />attached to this Agreement and <br /> <br />On August 9th , 19 79 , the City granted a Design <br /> <br /> approval to said property; <br /> <br />By the terms of the Desi~ Review approval, property <br /> <br />owner is required to install and maintain landscaping in accordance <br />with a plan, to be approved by the Planning Department prior to Build- <br />ing Permit approval; <br /> <br /> (4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br /> <br />NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: <br />1. Purpose. The purpose of this Agreement is to assure (a) <br />instal~atioD in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping. <br /> <br /> <br />
