6 <br /> THE CITY OF <br /> mci=s `°210 CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> May 18, 2021 <br /> Engineering <br /> TITLE: ADOPT RESOLUTIONS APPROVING THE ENGINEER'S REPORTS FOR <br /> LANDSCAPE MAINTENANCE DISTRICTS 1984-1 (PONDEROSA-DEL <br /> PRADO), 1993-1 (WINDSOR), 1993-2 (BONDE RANCH), 1994-1 (OAK <br /> TREE FARM), AND 1995-1 (MOLLER RANCH); DECLARING THE CITY'S <br /> INTENTION TO ASSESS THE PROPERTIES FOR THE COST TO <br /> OPERATE AND MAINTAIN THE DISTRICTS; AND SETTING JUNE 15, <br /> 2021, AT 7 P.M., AS THE DATE AND TIME FOR THE PUBLIC HEARING <br /> SUMMARY <br /> The annual Engineer's Reports for the maintenance of the Landscape Maintenance <br /> Districts (LMDs) in the Ponderosa (Del Prado), Windsor, Bonde Ranch, Oak Tree Farm, <br /> and Moller Ranch subdivisions have been completed for fiscal year 2021-22. The <br /> Engineer's Reports determine the assessment that will be levied against each property <br /> owner within each LMD for the electrical costs, maintenance, and irrigation of the <br /> special district landscaping that are installed as part of each development. It is <br /> recommended that City Council approve the Engineer's Report for each LMD, declare <br /> the intention to levy and collect assessments, schedule a public hearing for June 15, <br /> 2021, to receive testimony from those that will be subject to the assessments, and direct <br /> the City Clerk to advertise a Notice of Annual Hearing ten days prior to the hearing. All <br /> assessment amounts remain unchanged from previous years. However, this is <br /> unsustainable as costs have increased, which has resulted in the level of maintenance <br /> decreasing significantly since the districts were created. In addition, reserves for capital <br /> replacement are limited or non-existent. Staff hired a consultant that specializes in <br /> LMDs, SCI Consulting Group, to determine appropriate assessments for future years, <br /> perform public outreach to discuss the requirements and potential assessments, and <br /> hold a Proposition 218 compliant vote as is necessary for an increase in assessments. <br /> Votes for the Windsor and Bonde Ranch LMDs were scheduled for last year but put on- <br /> hold due to Alameda County's shelter-in-place order associated with the Covid-19 <br /> pandemic. <br /> RECOMMENDATION <br /> 1. Approve the Engineer's Reports. <br /> 2. Adopt the resolutions that direct filing of the annual reports; declare the intention to <br /> order improvements; and declare the intention to levy and collect assessments. <br /> 3. Schedule a public hearing for June 15, 2021, and authorize the City Clerk to <br /> advertise a Notice of Annual Hearing (Cal. Streets & Highways Code §22626) ten <br /> days prior to the hearing. <br />
