DEVELOPMENT DEFERMENT AGREEMENT <br /> <br /> THIS DEVELOPMENT DEFERI~ENT AGREEMENT (the "Agreement") <br /> <br />is made this 27th day of March, 1984, by and between TRACOR <br />MBA, a California corporation ("Developer"), and the CITY OF <br />PLEASANTON, a municipal corporation, ("City"). <br /> <br /> RECITALS <br /> <br /> A. Developer is the owner in fee of certain unimproved <br />real property (the "Property") located in Pleasanton, California, <br />designated as lots 1, 2, and 4 of Parcel Map 4137, more <br />particularly described in Exhibit A attached to this Agreement. <br /> <br /> B. Developer has purchased and now has outstanding <br />twenty-five (25) D.U.E. (Dwelling Unit Equivalent) sewer- <br />system connection permits ("Sewer Permits") for use in <br />development of the Property, such permits bearing Permit No. P-126, <br />having been issued by the Dublin-San Ramon Services District <br />("DSRSD") pursuant to Alameda County Superior Court Orders <br />in Civil Action No. 423134 filed December 19, 1972 and <br />April 22, 1980 (the "Court Orders"). <br /> <br /> C. Pursuant to the 1972 Court Order, building permits <br /> <br />must be obtained within three (3) years <br />any sewer-system connection permits, or <br />shall be canceled. <br /> <br /> D. Paragraph 8 of Exhibit B to <br />to and incorporated in the 1972 Court <br />where an owner/developer is <br /> <br />after purchase of <br />such sewer permits <br /> <br /> the Agreement, attached <br /> <br /> Order, provides that <br />precluded from obtaining the <br /> <br />-1- <br /> <br /> <br />
