i ,, ~ ~ s <br />FIRST AMENDMENT TO <br />DEVELOPMENT DEFERMENT AGREEMENT <br />THIS FIRST AMENDMENT TO DEVELOPMENT DEFERMENT AGREEMENT <br />is made this //f~c day of January, 1983, by and between THE <br />LEE SAMMIS COMPANY ("Developer") and the CITY OF PLEASANTON, <br />a municipal corporation ("City"). <br />RECITALS <br />A. Developer and City entered into that certain Development <br />Deferment Agreement (the "Agreement") dated January 12, 1982 <br />pertaining to that certain unimproved real property (the <br />"Property") located in Pleasanton, California, as more <br />particularly described in Exhibit "A" to the Agreement. <br />B. The Agreement provided in pertinent part that no <br />building permits would be issued on the Property prior to <br />January 12, 1983, in order to allow Developer time to perfect <br />plans and studies of the proposed development of the Property <br />and because of the City's desire to see construction take <br />place at reasonable intervals. <br />C. Due to circumstances not foreseen at the time of <br />execution of the Agreement, it is in the public interest <br />that the parties agree that no building permits will be <br />issued on Pad A of the Property prior to January 12, 1984. <br />Building permits on Pad E of the Property will continue to <br />be governed by the terms of the Agreement. <br />NOW, THEREFORE, in consideration of the mutual provisions <br />and the sum of One Thousand Dollars ($1,000.00) being paid <br />to City as a processing fee concurrently herewith, the <br />parties agree to amend the Agreement as follows: <br />-1- <br />
