EE~.NT <br />Pleasanton Park Business Center <br /> <br /> THIS DEVELOPmeNT DEFE~NT AGREEb~NT <br />into by and between DELTA PROPERTIES, <br />("Delta"), and the CITY OF PLEASANTON, <br />("City"). <br /> <br /> is made and entered <br />a general partnership <br /> <br /> a municipal corporation <br /> <br />RECITALS <br /> <br /> A. Delta is the owner in fee of certain unimproved <br />real property located in Pleasanton, California, designated <br />as Lots 11 and 12 of Tract 4788, as shovm in Exhibit "A", <br />attached to this agreement and incorporated herein. <br /> <br /> B. On February 24, 1981, City approved a development <br />plan for Pleasanton Park Business Center, designated as PUD- <br />80-14, and subsequently approved a final subdivision map <br />designated Tract 4788 and recorded in Alameda County on <br />January 7, 1982, containing the subject parcels, Lots 11 and <br />12. <br /> <br /> C. Delta has purchased and now has outstanding sixty <br />(60) D.U.E. (Dwelling Unit Equivalent) sewer system connection <br />permits for use in development of Lots 11 and 12, such <br />permits having been issued by the Dublin-San Eamon Services <br />District pursuant to Alameda County Superior Court Orders in <br />Civil Action No. 423134. These permits, bearing Permit <br />No. 459, were issued to Flying J~ Pelta's predecessor in <br />interest on September 28, 1979 as part of 130 D.U.E. sewer <br />system connection permits purchased for the entire Tract <br /> <br /> <br />
