DEVELOPMENT DEFERmeNT AGREE}~NT <br /> <br /> THIS DEVELOPI,~NT DEFERMENT AGREEMENT (the "Agreement") <br />is made this /~day of ~~ , 1982, by and <br />between FOOTHILL BUILDERS, a partnership, and PLEASANTON <br />ASSOCIATES, a partnership, (hereinafter referred to as <br />"Developer") and the CITY OF PLEASANTON, a municipal corpora- <br /> <br />tion (hereinafter referred to as "City"). <br /> <br /> RECITALS <br /> <br /> A. Developer is the owner of certain property on <br />Foothill Road co~m~only known as Tract 4373, Foothill Place, <br />consisting of thirteen (13) lots, as shown on Exhibit "A" <br />attached hereto and incorporated herein (the "Property"). <br /> <br /> B. Castlewood Enterprises purchased twenty-one (21) <br />sewer connection permits for property located at Foothill <br />Road and Bernal Avenue consisting of 18 acres. <br /> <br /> C. Developer subsequently purchased the property from <br />Castlewood Enterprises in'cluding 13 D.U.E. (Dwelling Unit <br />Equivalent) sewer-system connection permits for use in <br />development of the Property, said peri. its having been issued <br />by the Dublin-San Ramon Services District ("DSRSD") pursuant <br />to Alameda County Superior Court Order in Civil Action No. <br />423134 filed December 19, 1972 (the "Court Order"). <br /> <br /> D. Pursuant to the 1972 Court Order, building permits <br />must be obtained within three (3) years after purchase of <br />any sewer-system connection permits, or such sewer permits <br />shall be canceled.
