7 <br /> THE CITY OF <br /> ° CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON <br /> March 16, 2021 <br /> Fire <br /> TITLE: ADOPT A RESOLUTION DECLARING WEEDS, DIRT, RUBBISH, AND <br /> REFUSE UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES <br /> WITHIN THE CITY CONSTITUTE PUBLIC NUISANCES AND THAT THEY BE <br /> ABATED, AND SET A PUBLIC HEARING REGARDING THE ABATEMENT <br /> SUMMARY <br /> The Livermore-Pleasanton Fire Department (LPFD) Weed Abatement Program is a <br /> critical fire prevention program. The goal of the program is to prevent the loss of life and <br /> property due to uncontrolled wildfire in the urban/wildland interface through a working <br /> partnership between property owners and the LPFD. Staff will start notification to <br /> property owners upon adoption of the resolution. Abatement not completed by property <br /> owners prior to May 31, 2021 will be targeted for enforcement by the City contractor. <br /> RECOMMENDATION <br /> Adopt the attached resolution declaring that weeds, dirt, rubbish, and refuse upon or in <br /> front of certain described properties within the City constitute public nuisances and that <br /> they be abated. Set a public hearing for April 20, 2021 regarding the abatement of these <br /> nuisances and order the abatement thereof by May 31, 2021. <br /> FINANCIAL STATEMENT <br /> Property owners are invoiced for all work performed in addition to a 100 percent <br /> administrative charge and, if related litigation is required, all attorney's fees, expenses <br /> and costs. Unpaid invoices become a special assessment on the property owner's tax <br /> bill. All costs involved with the Weed Abatement Program are fully reimbursed and <br /> budgeted under Account#00120200-433166. <br />
