DocuSign Envelope ID: 1AB82317-D6D2-4445-A64C-616DE27F1 E85 <br /> RIGHT OF ENTRY FOR CONSTRUCTION <br /> AND <br /> LICENSE FOR LANDSCAPE MAINTENANCE <br /> 234 Main Street <br /> This Right of Entry for Construction and License for Landscape Maintenance (the <br /> "Agreement") is entered into this Feb, -3 , 2021, between the City of Pleasanton <br /> ("City") and KDCI Development LLC (the "Owner"), the owner of real property described <br /> in this Agreement. <br /> RECITALS <br /> WHEREAS, City is improving its public parking lot located at 50 Abbie Street (the <br /> "City Parking Lot"), which is adjacent to Owner's real property commonly known as 234 <br /> Main Street (the "Property", comprised of two parcels known as APNs 094 015701100 <br /> and 094 015701000); and <br /> WHEREAS, City's improvements to City Parking Lot include increasing parking <br /> spaces and installing landscaping, and <br /> WHEREAS, City will also make improvements to Owner's Property as described <br /> in this Agreement; and <br /> WHEREAS, Owner is willing to allow City to enter onto portions of the Property to <br /> make improvements to City Parking Lot, as well as make improvements to Owner's <br /> Property, subject to the terms of this Agreement. <br /> NOW, THEREFORE, in consideration of the mutual promises contained in this <br /> Agreement, the parties agree as follows: <br /> 1 . Improvements to Owner's Property. Without cost to Owner, the City, its <br /> employees and contractors will make the following improvements to Owner's Property <br /> as follows: <br /> a. Replace approximately 350 square feet of existing landscaping area with <br /> paved asphalt concrete surface. <br /> b. Install 134 L.F. of concrete curb <br /> c. Install 64 L.F. wooden fence on concrete curb; <br /> d. Modify backdoor building exit to inward swing; <br /> e. Replace existing concrete backdoor step; <br /> f. Install 5ft path way connection with ADA truncated dome and striping <br /> between private property and public pathway; and <br /> 1 <br />
