1 7 <br /> THE CITY OF <br /> ma - "' CITY COUNCIL AGENDA REPORT <br /> pLEASANTON® <br /> January 19, 2021 <br /> Community Development <br /> TITLE: P20-0412, CITY OF PLEASANTON - CONSIDER INTRODUCTION OF AN <br /> ORDINANCE APPROVING AMENDMENTS TO CHAPTERS 18.08, 18.28, <br /> 18.32, 18.36, 18.44, 18.46, 18.84, 18.88 AND 18.106 OF THE PLEASANTON <br /> MUNICIPAL CODE TO COMPLY WITH STATE LEGISLATION FOR <br /> ACCESSORY DWELLING UNITS; AND CONSIDER ADOPTION OF A <br /> RESOLUTION MODIFYING THE MASTER FEE SCHEDULE REGARDING <br /> IMPACT FEES FOR ACCESSORY DWELLING UNITS <br /> SUMMARY <br /> In 2019, the Governor signed into law six different bills (Senate Bill 13, Assembly Bill 68, <br /> Assembly Bill 881 , Assembly Bill 670, Assembly Bill 587, and Assembly Bill 671) that <br /> change the regulations for accessory dwelling units (ADUs) and junior accessory <br /> dwelling units (JADUs). In 2020, the legislature passed and adopted Assembly Bill 3182 <br /> regarding ADUs and JADUs, which became effective on January 1 , 2021 . These new <br /> rules build upon the changes to law regarding ADUs enacted in 2017. Since local ADU <br /> ordinances are required to be in conformance with state law, amendments to the City's <br /> existing regulations are proposed, to match the new requirements for ADUs and JADUs. <br /> The Planning Commission reviewed the proposed amendments to the Pleasanton <br /> Municipal Code (PMC) at its October 28, 2020, meeting; the amendments to the <br /> municipal code are now before the City Council for final review. Also part of the City <br /> Council action is an amendment to the Master Fee Schedule as it applies to impact fees <br /> for accessory dwelling units. <br /> PLANNING COMMISSION RECOMMENDATION <br /> The Planning Commission recommended the City Council approve the proposed draft <br /> amendments to the ADU ordinance at its October 28, 2020, meeting. <br /> RECOMMENDATION <br /> 1 . Find that the proposed amendment to the Municipal Code is statutorily exempt from <br /> the provisions of the California Environmental Quality Act (CEQA) pursuant Public <br /> Resources Code Section 21080.17 and categorically exempt per CEQA Guidelines <br /> Section 15303; <br /> 2. Introduce the draft ordinance, find the subject code amendment consistent with the <br /> General Plan, and approve Case P20-0412, amendment to the Pleasanton <br /> Municipal Code as shown in Attachment 1 ; and <br /> 3. Adopt a resolution to amend the Master Fee Schedule regarding impact fees for <br /> accessory dwelling units (Attachment 2). <br />
