9 <br /> THE CITY OF <br /> m , CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON. <br /> June 16, 2020 <br /> Engineering <br /> TITLE: 2020-21 ANNUAL ASSESSMENTS FOR LIGHTING AND LANDSCAPE <br /> MAINTENANCE DISTRICTS 1984-1 (PONDEROSA-DEL PRADO), 1993-1 <br /> (WINDSOR), 1993-2 (BONDE RANCH), 1994-1 (OAK TREE FARM) AND <br /> 1995-1 (MOLLER RANCH) <br /> SUMMARY <br /> The annual assessments for the maintenance of the Lighting and Landscape <br /> Maintenance Districts (LMDs) in the Ponderosa-Del Prado, Windsor, Bonde Ranch, Oak <br /> Tree Farm, and Moller Ranch subdivisions have been calculated for FY 2020/21. All <br /> districts are underfunded as assessments have not been increased since the passage of <br /> Proposition 218 in 1996. In addition, reserves for capital replacement are limited or non- <br /> existent. <br /> Staff had hired a consultant that specializes in LMDs, SCI Consulting Group, to <br /> determine appropriate assessments for future years, perform public outreach to discuss <br /> the requirements and potential assessments, and hold a Proposition 218 compliant vote <br /> as is necessary to increase assessments. Votes for the Windsor and Bonde Ranch <br /> LMDs were scheduled for this year but put on hold due to Alameda County's shelter-in- <br /> place order associated with the Covid-19 pandemic. <br /> As such, all assessment amounts are proposed to remain unchanged until such time that <br /> the analysis and a Proposition 218 compliant vote can take place. <br /> RECOMMENDATION <br /> 1 . Open and hold a public hearing to receive comments regarding the levy of annual <br /> assessments for each of the Lighting and Landscape Maintenance Districts. <br /> 2. Adopt a resolution confirming the Engineer's Report, and levying assessments for <br /> each of the Lighting and Landscape Maintenance Districts. <br /> 3. Appropriate $11,560 from the applicable City Funds (General Fund, Water Fund and <br /> Sewer Fund) to the respective Lighting and Landscape Maintenance Districts. <br /> FINANCIAL STATEMENT <br /> As required by law, the City will continue to incur a fiscal impact for those parcels that <br /> provide a "general benefit" and are City-owned. To that end, the City will pay $16.62 for <br /> Parcel 946-4563-125 (Del Prado Park); $9,703 for the "general benefit" area along the <br /> Arroyo in District 1984-1 (Ponderosa-Del Prado); $252.91 for Parcel 948-0014-1-39 <br />
