ORDINANCE NO. 2204 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADDING <br /> MUNICIPAL CODE SECTION 18.140.030 FINES AND RESTRICTIONS ON FUTURE <br /> DEVELOPMENT FOR ILLEGAL HISTORIC BUILDING DEMOLITION TO THE <br /> PLEASANTON MUNICIPAL CODE <br /> WHEREAS, the General Plan — Open Space and Conservation Element — Goal 4 and <br /> Policy 5; the General Plan — Housing Element — Existing Housing Condition - Policy 39 and <br /> Program 39.1; and the Downtown Specific Plan — Land Use and Design Goals - LD-G.5 and <br /> Historic Preservation Policies - HP-P.2 and HP-P.3, describe the City's interest in the <br /> preservation of historic buildings; and <br /> WHEREAS, the City of Pleasanton has filed an application, P19-0342, to add a new <br /> Section 18.140.030 Fines and Restrictions on Future Development for Illegal Historic Building <br /> Demolition to the Municipal Code to promote these city goals and policies related to historic <br /> building preservation; and <br /> WHEREAS, the Planning Commission, at its November 13, 2019 meeting, unanimously <br /> recommended adoption of the new Section 18.140.030; and <br /> WHEREAS, on December 17, 2019, the City Council held a duly-noticed public hearing <br /> and considered the agenda report, staff recommendations, and comments from the public <br /> regarding the proposed ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Finds that the addition to the Municipal Code has no possibility to have a <br /> significant effect on the environment per Title 14 California Code of Regulations §15061(b)(3). <br /> Section 2. Finds that: (a) historic buildings provide cultural and aesthetic benefit to <br /> the community, sustain the long-term potential increase in property values which encourages <br /> quality development, and help create a community identity and foster civic pride, which <br /> enhances the attractiveness of the city to residents and visitors; and (b) historic buildings <br /> cannot be replaced when demolished, resulting in a permanent loss for the entire community. <br /> Section 3. Adds to Chapter 18.140 Penalties a new Municipal Code Section <br /> 18.140.030 as follows: <br /> 18.140.030 Fines and Restrictions on Future Development for Illegal Historic Building <br /> Demolition. <br /> A. Any property owner who demolishes, or causes to be demolished, any historic building in <br /> the city is subject to fines and restrictions on future development unless the owner received <br /> prior written city approval: in conjunction with a new development application or other code <br />
