THE CITY OF
' ~ CITY COUNCIL AGENDA REPORT
pLEASANTON
November 5, 2019
Engineering
TITLE: ADOPT A RESOLUTION ORDERING THE SUMMARY VACATION OF A
PORTION OF A PUBLIC SERVICE EASEMENT LOCATED AT 3802
STANLEY BOULEVARD AND RELATED TO TRACT 8245 (IRBY
RANCH)
SUMMARY
On August 10, 2016, the Planning Commission recommended the approval of PUD-
110, a Planned Unit Development (PUD) application by Irby Ranch, LLC to construct 87
new single-family homes and related infrastructure on an approximately 10.6-acre site,
create an approximately 1.64-acre lot to be dedicated to the City for affordable housing,
and establish an open space/arroyo parcel on 2.8 acres, on a combined 15.03-acre site
located at 3988 First Street, 3780 Stanley Boulevard, and 3878 Stanley Boulevard.
On February 7, 2017, the City Council approved PUD-110 and Vesting Tentative Map
8245 by adopting Ordinance No. 2157 and Resolution 17-914, respectively.
On June 19, 2018, the City Council approved the final map, improvement plans, and
subdivision agreement for Tract 8245. On August 15, 2018, Tract Map 8245 (Irby
Ranch) was recorded.
On September 10, 2019, Meritage realized an error had occurred when coordinating the
approved site plans with the final map and requested that the City to vacate a 4-foot
wide portion of the newly created existing public service easement (PSE) located at
3802 Stanley Boulevard. Staff reviewed the final map, understands the error, and
determined that the new 8-inch diameter water main and the new joint trench are
adequately located within the PSE that is to remain and that the 4-foot wide portion of
the PSE is not necessary. However, since the map has been recorded, vacating the
portion of the PSE must follow a standard process, with all utilities notified of the intent
to vacate and allowed 30-days to respond. The utilities were notified and no objections
to the vacation were received. Staff recommends City Council adopt the resolution
vacating the portion of the PSE as requested.
RECOMMENDATION
1. Adopt a resolution ordering the summary vacation of a public service easement
located at 3802 Stanley Boulevard and related to Tract 8245 (Irby Ranch).
FINANCIAL STATEMENT
There will be no fiscal impact to the City by vacating the public service easement.
