RESOLUTION NO. PC-2019-21 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br /> RECOMMENDING THAT THE CITY COUNCIL ADOPT A NEGATIVE DECLARATION <br /> AND APPROVE THE APPLICATIONS FOR REZONING, PLANNED UNIT <br /> DEVELOPMENT (PUD) AND CONDITIONAL USE PERMIT FOR THE HOPYARD ROAD <br /> 7-ELEVEN CONVENIENCE STORE AND SHELL FUEL STATION REDEVELOPMENT <br /> LOCATED AT 3760 AND 3790 HOPYARD ROAD, AS FILED UNDER CASE NOS. <br /> PUD-134 (PLANNED UNIT DEVELOPMENT), P18-0332 (CONDITIONAL USE PERMIT) <br /> AND P18-0334 (REZONE) <br /> WHEREAS, on November 28, 2018, Brad Hirst ("Applicant") applied for <br /> applications at the 7-Eleven convenience store and Shell service station sites located at <br /> 3760 and 3790 Hopyard Road for: (1) rezoning from Neighborhood Commercial (C-N) <br /> District to Planned Unit Development— Commercial (PUD-C) District; (2) PUD <br /> Development Plan to demolish the existing 7-Eleven convenience store, Shell auto <br /> service/smog check building, and Shell service station canopy and construct an <br /> approximately 3,034-square-foot 7-Eleven convenience store, 1,290-square-foot <br /> drive-through carwash building, 3,311-square-foot Shell service station canopy, and <br /> related on-site improvements; and (3) Conditional Use Permit to operate a self-service <br /> station with a drive-through carwash and convenience store with the sale of alcoholic <br /> beverages ("Project"); <br /> WHEREAS, the site is designated Retail/Highway/Service Commercial/Business <br /> and Professional Offices in the General Plan; and <br /> WHEREAS, on April 10, 2019, the Planning Commission, following public notice, <br /> conducted a work session, where the Project was presented as a public hearing item; and <br /> WHEREAS, on August 1, 2019, Notice of Public Hearing and Notice of Intent (NOI) <br /> to Adopt a Draft Initial Study and Proposed Negative Declaration were sent to interested <br /> parties and property owners/residents in accordance with California Environmental Quality <br /> Act (CEQA) Guidelines Section 15072; and <br /> WHEREAS, on August 28, 2019, the Planning Commission, following public notice, <br /> conducted a public hearing where it considered the written agenda report, public <br /> testimony, related project materials, and staff recommendations; and <br /> WHEREAS, on August 28, 2019, the Planning Commission reviewed the Initial <br /> Study (IS) and Negative Declaration (ND) prepared in accordance with Sections 15070 <br /> and 15072 of the CEQA Guidelines. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br /> Pleasanton, based on the entire record of proceedings, including the oral and written <br /> agenda reports and all public comment and testimony: <br />ll install temporary 6-foot tall chain-link fencing (or other fence type acceptable to the <br /> Landscape Architecture Division) outside of the existing tree drip lines. The location of the tree <br /> protection fencing shall be shown on the demolition plans (if applicable), grading, building, and/or <br /> landscape plans. The fencing shall remain in place until final landscape inspection by the <br /> Landscape Architecture Division. Removal of such fencing prior to approval may result in a "stop <br /> work order." <br /> 111. PROJECT PLANS: The following statements shall be printed on the demolition, grading and <br /> landscape plans where applicable to the satisfaction of the City Landscape Architect prior to <br /> issuance of building permits: <br /> a. No existing tree may be trimmed or pruned without prior approval by the City <br /> Landscape Architect. <br /> b. Utilize best efforts to locate any new utility trenches outside of the existing canopy of <br /> the trees to be saved.
