THE CITY OF �' <br />_ ,,, .:,, :atcfl � <br />j�L-E�S�4NTONo <br />1 <br />CITY COUNCIL AGENDA REPORT <br />October 1, 2019 <br />City Attorney <br />TITLE: APPROVE FIFTH AMENDMENT TO PROFESSIONAL SERVICES <br />AGREEMENT WITH JARVIS, FAY & GIBBON FOR PAYMENT TO <br />ENVIRONMENTAL SCIENCE ASSOCIATES FOR JOHNSON DRIVE <br />ECONOMIC DEVELOPMENT ZONE SUPPLEMENTAL ENVIRONMENTAL <br />STUDY <br />SUMMARY <br />The City is utilizing the specialized expertise of the Jarvis, Fay &Gibson law firm <br />regarding the Johnson Drive Economic Development Zone (JDEDZ). A Fifth <br />Amendment to the existing Professional Services Agreement is recommended to <br />provide for up to an additional $50,000 for pass-through payment to Environmental <br />Science Associates for the JDEDZ supplemental environmental study. This amount has <br />increased due to the large number of complex comments received regarding the <br />supplemental environmental study. <br />RECOMMENDATIONS <br />1. Authorize the City Manager to execute a Fifth Amendment to the Professional <br />Services Agreement with Jarvis, Fay &Gibson. <br />2. Increase Professional Services budget by $50,000 (00130100-430101) <br />3. Increase Reimbursement Revenue budget by $25,000 (00130302-357491) <br />4. Reduce General Fund Contingency by $25,000 (00199100-433170) <br />FISCAL IMPACT <br />Half of the cost of this $50 000 increase will be allocated from the General Fund <br />Contingency and the remaining half will be covered through reimbursements by Costco <br />(to be placed in account 00130100-357491). <br />
