THE CITY OF 8 <br /> CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON: <br /> August 20, 2019 <br /> Engineering <br /> TITLE: APPROVE PLANS AND SPECIFICATIONS, REVIEW BIDS, AND AWARD <br /> CONSTRUCTION CONTRACT TO SUAREZ & MUNOZ CONSTRUCTION, <br /> INC. IN THE AMOUNT OF $394,240 FOR THE PIONEER CEMETERY <br /> ENTRY AND WAYFINDING IMPROVEMENTS PROJECT, CIP NO. 18750 <br /> SUMMARY <br /> Plans for the Pioneer Cemetery Entry and Wayfinding Improvements Project, CIP No. <br /> 18750, were completed and advertised for construction bid in July 2019. Seven bids <br /> were received on August 8, 2019. Bids ranged from a low of $394,240 from Suarez & <br /> Munoz Construction, Inc. (SMC), to a high of $577,527. A letter protesting the bid was <br /> received from the second lowest bidder, Marina Landscape, Inc. ($408,992.50) <br /> requesting that the low bid from SMC be found as non-responsive due to issues with <br /> how SMC completed the bid form. Staff from Engineering and the City Attorneys' Office <br /> reviewed the issue and determined the irregularity did not create any ambiguity in the <br /> SMC bid amount nor result in a competitive advantage for SMC. Staff recommends the <br /> contract be awarded to SMC for the low bid amount of $394,240. <br /> RECOMMENDATION <br /> 1. Approve plans and specifications for this project. <br /> 2. Review bids and award the construction contract to SMC for the low bid amount <br /> of $394,240. <br /> 3. Authorize the City Manager to enter into the project contract. <br /> 4. Authorize the Director of Engineering to approve and execute any required <br /> contract change order(s) for up to a not-to-exceed amount of $40,000 <br /> (approximately 10 percent of the construction contract) for unforeseen yet <br /> necessary related work. <br /> 5. Transfer $170,882 from Pioneer Cemetery Master Plan, CIP No. 15408 to <br /> complete funding for this project. <br /> FINANCIAL STATEMENT <br /> Funding for this project is included in the Capital Improvement Program budgets for CIP <br /> No. 18750 and CIP No. 15408. The anticipated total expenditure for this project is <br /> $480,882. See Attachment 3 for a summary of funding and anticipated expenditures. <br />
