CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-007 <br /> <br />RESOLUTION APPROVING A NEGATIVE DECLARATION FOR THE <br />APPLICATION OF VALLEY PARK ASSOCIATES, LLC, FOR PUD <br />DEVELOPMENT PLAN APPROVE, AS FILED UNDER CASE PUD-30/PSP-5 <br /> <br />WHEREAS, <br /> <br />at its meeting of February 17, 2004, the City Council approved a proposed <br />negative declaration for the application of Valley Park Associates, LLC, for PUD <br />rezoning and development plan approval to construct an approximately <br />15,300-square-foot office building and related site improvements and for Specific <br />Plan Amendment to the Downtown Specific Plan to allow a two-story building at <br />325 Ray Street where only one-story buildings are permitted; and <br /> <br />WHEREAS, <br /> <br />the City Council received and reviewed the Initial Study, dated November 17, <br />2003, and received the recommendations of the staff and Planning Commission; <br />and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held on February 17, 2004, at which time the <br />public was given the opportunity to comment on the environmental impacts of the <br />proposed project; and <br /> <br />WHEREAS <br /> <br />the City Council has reviewed the potential impacts in accordance with the <br />applicable state and local guidelines governing the preparation of Negative <br />Declarations and Environmental Impact Reports; and <br /> <br />WHEREAS the City Council finds that the proposed project would not have any significant <br /> adverse effects on the environment; and <br /> <br />WHEREAS the City Council further fmds that the proposed project will have no potential for <br /> adverse impacts on the site's wildlife. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br />Approves the Negative Declaration for the application of Valley Park Associates, <br />LLC, for PUD rezoning and development plan approval to construct an <br />approximately 15,300-square-foot office building and related site improvements <br />and for Specific Plan Amendment to the Downtown Specific Plan to allow a <br />two-story building at 325 Ray Street where only one-story buildings are permitted. <br /> <br /> <br />
