THE CITY OF 21 LEASANTON® CITY COUNCIL AGENDA REPORT August 21, 2018 Community Development TITLE: CONSIDER THE FOLLOWING ACTIONS RELATED TO URGENCY (INTERIM) ORDINANCE NO. 2182 PROHIBITING THE ISSUANCE OF SPECIFIED APPROVALS AND PERMITS FOR NEW OR EXPANDING MASSAGE ESTABLISHMENTS WITHIN THE DOWNTOWN SPECIFIC PLAN AREA: (1) ISSUE A WRITTEN REPORT DESCRIBING THE MEASURES TAKEN TO ALLEVIATE THE CONDITION WHICH LED TO THE ADOPTION OF THE ORDINANCE; AND (2) CONSIDER EXTENDING THE ORDINANCE FOR 22 MONTHS AND 15 DAYS SUMMARY On July 17, 2018, the City Council adopted Urgency (Interim) Ordinance No. 2182 ("Ordinance") that prohibits new or expanding massage establishments within the Downtown Specific Plan (DSP) area. The Ordinance is in effect for a period of 45 days. In order to allow further evaluation and possible adoption of additional regulations for massage establishments, an extension of the Ordinance is proposed, for a period of 22 months 15 days. In addition, a modification is proposed to the Ordinance in response to public comment to allow for an increase in the number of massage technicians at one time with Minor Conditional Use Permit approval. RECOMMENDATION Staff recommends that the City Council take the following actions related to the Ordinance: (1) issue a written report describing the measures taken to alleviate the condition which lead to the adoption of the Ordinance; and (2) consider extending the Ordinance as modified for 22 months and 15 days. FINANCIAL STATEMENT The extension of the Ordinance does not have a financial impact on the City.
