PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-25 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF KENNETH <br />AND PAMELA CHRISMAN FOR AN EXTENSION OF THE DEVELOPMENT <br />AGREEMENT FOR 1944 THREE OAKS DRIVE (FORMERLY 1944 VINEYARD <br />AVENUE), AS FILED UNDER CASE PDAM-2 <br />WHEREAS, Kenneth and Pamela Chrisman have applied for an extension of the <br />Development Agreement for five years for the property located at <br />1944 Three Oaks Drive (formerly 1944 Vineyard Avenue) from 2012 to <br />2017; and <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development — Low <br />Density Residential) District; and <br />WHEREAS, the City Council approved the Development Agreement between the City <br />of Pleasanton and Kenneth and Pamela Chrisman on June 4, 2002; and <br />WHEREAS, at its duly noticed public hearing of August 12, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the underlying planned unit development, original development <br />agreement, and subsequent design modification have all been subject to <br />environmental review, including an Environmental Impact Report (EIR) for <br />the original approval, pursuant to the California Environmental Quality <br />Act (CEQA); further, the physical environment has not significantly <br />changed since that time, and the extension of the Development <br />Agreement does not modify the approved project; and <br />WHEREAS, the Planning Commission determined that the extension of the <br />Development Agreement is consistent with the General Plan. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of the application of Kenneth and Pamela <br />Chrisman for an extension of the Development Agreement for five years <br />for the property located at 1944 Three Oaks Drive (formerly 1944 Vineyard <br />Avenue) from 2012 to 2017, a copy of which Development Agreement is <br />on file with the Planning Division of the Community Development <br />Department. <br />1 <br />
