PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-21 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF THE <br />CITY OF PLEASANTON TO AMEND CHAPTER 18.40 (OFFICE DISTRICT) <br />AND CHAPTER 18.44 (C COMMERCIAL DISTRICTS) OF THE <br />PLEASANTON MUNICIPAL CODE REGARDING MASSAGE ESTABLISHMENTS, <br />AS FILED UNDER CASE PRZ-43 <br />WHEREAS, the City of Pleasanton has filed an application to amend Chapter 18.40 <br />(Office District) and Chapter 18.44 (C Commercial Districts) of the <br />Pleasanton Municipal Code to establish consistency with amendments <br />made to Chapter 6.24 of the Pleasanton Municipal Code to comply with <br />SB 731 legislation related to certification of massage establishments; and <br />WHEREAS, at its duly noticed public hearing of July 8, 2009, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of <br />the City staff concerning the amendments to the Municipal Code; and <br />WHEREAS, zoning ordinance amendments are exempt from the requirements of the <br />California Environmental Quality Act (CEQA) per Section 15061(b)(3); and <br />WHEREAS, the Planning Commission determined that the proposed amendment, <br />when implemented, would reflect existing permitted land use designations <br />for massage establishments, provide a reference to Chapter 6.24 for <br />operational requirements for massage establishments, and simplify the <br />existing language without altering its intended meaning. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of Case PRZ-43, the application of the City of <br />Pleasanton to amend Chapter 18.40 (Office District) and Chapter 18.44 <br />(C Commercial Districts) of the Pleasanton, Municipal Code to establish <br />consistency with amendments made to Chapter 6.24 of the Pleasanton <br />Municipal Code to comply with SB 731 legislation related to certification of <br />massage establishments, as shown on Exhibit A, attached hereto and <br />made part of this case by reference. <br />Section 2. This resolution shall become effective immediately upon its passage and <br />adoption. <br />
