} <br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-20 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF THE <br />CITY OF PLEASANTON TO AMEND SECTION 18.84.090 OF THE PLEASANTON <br />MUNICIPAL CODE REGARDING FENCING, AS FILED UNDER CASE PRZ-27 <br />WHEREAS, the City of Pleasanton has filed an application to amend <br />Section 18.84.090 of the Pleasanton Municipal Code to remove the <br />noticing requirement for over -height fences; and <br />WHEREAS, at its duly noticed public hearing of July 8, 2009, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of <br />the City staff concerning the amendments to the Municipal Code; and <br />WHEREAS, zoning ordinance amendments are exempt from the requirements of the <br />California Environmental Quality Act (CEQA) per Section 15061(b)(3); and <br />WHEREAS, the Planning Commission determined that the proposed amendment,,,- <br />when <br />mendment;when implemented, would eliminate unnecessary delays and allow <br />homeowners an opportunity to construct a fence to which adjoining <br />neighbors are already agreeable. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Recommends approval of Case PRZ-27, the application of the City of <br />Pleasanton to amend Section 18.84.090 of the Pleasanton Municipal <br />Code to remove the noticing requirement for over -height fences, as shown <br />on Exhibit A, attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective immediately upon its passage and <br />adoption. <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 8THrDAY OF JULY 2009 BY THE FOLLOWING VOTE: <br />AYES: <br />Commissioners Blank, Narum, Olson, Pearce, and Pentin. <br />NOES: <br />None. <br />ABSTAIN: <br />None. <br />RECUSED: <br />None. <br />ABSENT: <br />None. <br />
