} PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC -2009-20 RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF THE CITY OF PLEASANTON TO AMEND SECTION 18.84.090 OF THE PLEASANTON MUNICIPAL CODE REGARDING FENCING, AS FILED UNDER CASE PRZ-27 WHEREAS, the City of Pleasanton has filed an application to amend Section 18.84.090 of the Pleasanton Municipal Code to remove the noticing requirement for over -height fences; and WHEREAS, at its duly noticed public hearing of July 8, 2009, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning the amendments to the Municipal Code; and WHEREAS, zoning ordinance amendments are exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15061(b)(3); and WHEREAS, the Planning Commission determined that the proposed amendment,,,- when mendment;when implemented, would eliminate unnecessary delays and allow homeowners an opportunity to construct a fence to which adjoining neighbors are already agreeable. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Recommends approval of Case PRZ-27, the application of the City of Pleasanton to amend Section 18.84.090 of the Pleasanton Municipal Code to remove the noticing requirement for over -height fences, as shown on Exhibit A, attached hereto and made part of this case by reference. Section 2. This resolution shall become effective immediately upon its passage and adoption. THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON ON THE 8THrDAY OF JULY 2009 BY THE FOLLOWING VOTE: AYES: Commissioners Blank, Narum, Olson, Pearce, and Pentin.
