PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-08 <br />RESOLUTION APPROVING THE APPLICATION OF TOM KUBO/WILLIAM WOOD <br />ARCHITECTS, HANA JAPAN, FOR DESIGN REVIEW APPROVAL AND <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE PDR-804/PCUP-233 <br />WHEREAS, Tom Kubo/William Wood Architects, Hana Japan, has filed for an <br />application for Design Review approval to construct an approximately <br />6,000-squ6re-foot building at 11991 Dublin Canyon Road for Hana Japan <br />Steak House, and for a Conditional Use Permit to serve alcoholic <br />beverages after 10:00 p.m.; and <br />WHEREAS, zoning for the property is C -C and PUD -0 (Central Commercial and <br />Planned Unit Development — Office) District; and <br />WHEREAS, at its duly noticed public hearing of March 11, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission approved the Negative Declaration prepared for <br />this project; and <br />WHEREAS, the Planning Commission made the following findings for the conditional <br />use permit: <br />The location of the proposed conditional use is in accordance with <br />the objectives of the Zoning Ordinance and the purpose of the <br />district in which the site is located. <br />The objectives of the Zoning Ordinance include fostering a harmonious, <br />convenient, workable relationship among land uses; protecting existing <br />land use form inharmonious influences and harmful intrusions; and <br />ensuring that public and private lands ultimately are used for the purposed <br />which are most appropriate and beneficial to the City as a whole. The <br />proposed use is an incidental service available for the restaurant patrons. <br />As conditioned, the food service staff would be required to undergo a <br />training program such as TIPS (Training for Intervention Procedures) that <br />is designed to prevent intoxication, underage drinking, and drunk driving. <br />Therefore, this finding can be made. <br />v <br />
