PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2009-03 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF DUTRA <br />TRUST FOR PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN <br />APPROVAL, AS FILED UNDER CASE PUD -77 <br />WHEREAS, Dutra Trust has applied for Planned Unit Development (PUD) <br />development plan approval to subdivide a ten -acre site located at <br />1053 Happy Valley Road into five single-family residential lots and one <br />open space parcel; and <br />WHEREAS, at its duly noticed public hearing of January 14, 2009, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the Planning Commission recommended approval for the Negative <br />Declaration prepared for this project; and <br />WHEREAS, the Planning Commission determined that the proposed development plan <br />is appropriate for the site; and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed development is in the best interests of the public <br />health, safety, and general welfare. <br />The proposed project, as conditioned, meets all applicable City standards <br />concerning public health, safety, and welfare, e.g., vehicle access, <br />geologic hazards (not within a special studies zone), and flood hazards. <br />The proposed development plan is designed to be compatible with the <br />adjacent land uses, including the City Golf Course area located along the <br />property's east. <br />The proposed development plan is designed in conformance with the <br />Pleasanton General Plan and the Happy Valley Specific Plan designations <br />for this site and all other relevant policies and programs. <br />Detailed geologic studies have been done in conjunction with the Happy <br />Valley Specific Plan and with the proposed development plan which have <br />been peer-reviewed and accepted by the City Engineer. Mitigation <br />measures have been incorporated into the project design to achieve <br />stable slope banks and site grading. The report did not identify any <br />landslide or seismic safety issues pertaining to the development of these <br />sites. <br />
