PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-47 <br />RESOLUTION DENYING THE APPEAL OF ANNE FOX, PAP -125, THEREBY <br />UPHOLDING THE ZONING ADMINISTRATOR'S APPROVAL OF THE APPLICATION <br />OF COMERICA BANK FOR DESIGN REVIEW, AS FILED UNDER CASE PDR -725 <br />WHEREAS, Comerica Bank has applied for design review to install an automated teller' <br />machine (ATM), night deposit box, and wall -mounted light on the south <br />wall facing Division Street for Comerica Bank located at 600 Main Street; <br />and. <br />WHEREAS, zoning for the property is C -C (Central Commercial), Downtown <br />Revitalization, and Core Area Overlay District; and <br />WHEREAS, on August 27, 2008, the Zoning Administrator approved the application for <br />design review; and <br />WHEREAS, on September 2, 2008, Anne Fox appealed the Zoning Administrator's <br />decision to the Planning Commission; and <br />WHEREAS, at its duly noticed public hearing of September 24, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, the subject building is not listed in the California Register of Historical <br />Resources, but it is considered eligible for listing in the California Register <br />and, thus, is a "historic resource" as defined by the California <br />Environmental Quality Act (CEQA), Section 15604.5; further, the proposed <br />project would not result in the physical demolition, destruction, relocation, <br />or alteration of the resource or its immediate surroundings such that the <br />significance of the historical resource would be materially impaired; <br />therefore, this project would not result in a substantial adverse change in <br />the significance of a historical resource per Section 15064.5 of CEQA; <br />furthermore, minor alterations to existing structures involving negligible or <br />no expansion of use are categorically exempt (Section 15301, Class 1) <br />from the requirements of CEQA. <br />WHEREAS, the Planning Commission determined that the proposed project is <br />consistent with the appearance of the existing buildings in the area. <br />
