PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-18 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />STEVE MAESTAS AND MIKE CAREY FOR PLANNED UNIT DEVELOPMENT (PUD) <br />REZONING, AS FILED UNDER CASE PUD -73 <br />WHEREAS, Steve Maestas and Mike Carey have applied for Planned Unit <br />Development (PUD) rezoning of an approximately .22 -acre parcel located <br />at 204 Kottinger Drive from the RM -4,000 (Multiple -Family Residential) <br />District to the PUD -HDR (Planned Unit Development — High Density <br />Residential) District; and <br />WHEREAS, at its duly noticed public hearing of April 23, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS,, this project is categorically exempt from environmental review pursuant to <br />the California Environmental Quality Act (CEQA) Class 32, <br />Section 15332 (a -e); and <br />WHEREAS, the Planning Commission determined that the proposed development plan <br />is appropriate for the site; and <br />WHEREAS, the Planning Commission made the following findings: <br />1. The plan is in the best interests of the public health, safety, and <br />general welfare. <br />As conditioned, the proposed development meets all applicable City <br />standards concerning public health, safety, and welfare, including vehicle <br />assess and geologic and flood hazards. The project developer will install <br />all on-site infrastructures with connections to the municipal systems in <br />order to serve the site. Adequate storm drain, sanitary sewer, and water <br />service utilities are present near the development and are sufficient to <br />serve the new buildings. Public street access is provided to all structures <br />for police, fire, and other emergency response vehicles. The buildings are <br />designed to meet the requirements of the Building Code, Fire Code, and <br />other applicable City codes. Therefore, this finding can be made. <br />2. The plan is consistent with the City's General Plan. <br />The proposed project's land use conforms to the High Density Residential <br />land use designation for the project site. The General Plan defines High <br />Density Residential as greater than eight dwelling units per acre. The <br />proposed project, with five units on approximately .22 acres, conforms to <br />this designation. Therefore, this finding can be made. <br />
